Navigating the eServices Panel and eServices Contract

If you are an IT services provider looking to do business with the Victorian government, you may have heard of the eServices Register. This is a list of approved suppliers that can compete for government IT projects in a streamlined online environment. But how do you enter into a tender and negotiate an eServices contract with the government? In this blog post, we will explain the basics of the eServices Register and the contract variables that you can negotiate with the government buyer.

What is the eServices Register?

The eServices Register is a whole of Victorian government register that offers multiple suppliers for IT services, equipment and maintenance. It is managed by the Department of Government Services and covers a range of service categories, such as professional services, hosted services, geo-spatial data services, etc.

To join the register, you need to register as a supplier online and submit an application that provides details about your company, services, pricing, insurance, etc. You also need to agree to the terms and conditions of the eServices Register Contract, which is the contract used in conjunction with the register. Your application will be assessed by the department and you will be notified of the outcome within 10 business days.

If your application is successful, you will be able to access the eServices portal and view the opportunities posted by government buyers. You can also receive email notifications of new opportunities that match your service categories. To bid for an opportunity, you need to submit a response online, following the instructions and requirements specified by the buyer. You can also ask questions and communicate with the buyer through the portal.

The buyer will evaluate your response and select the best supplier for their needs. You will be notified of the outcome and receive feedback on your response. If you are selected, you will need to sign a work order with the buyer, which will outline the scope, deliverables, milestones, payment terms, etc. of the project. The work order will be governed by the eServices Register Contract.

What are the contract variables?

The eServices Register Contract is a standard contract that applies to all engagements with suppliers on the register. However, there are some variables that can be negotiated between the supplier and the government buyer, depending on the nature and complexity of the project. These variables are documented in a separate document called the Contract Variables, which forms part of the work order.

Some of the variables that can be negotiated under an eServices contract are:

  • The Commencement Date and Completion Date of the Services
  • The extension of the Contract term, if any
  • The description of the Services to be provided
  • The Service Levels and Service Credits, if applicable
  • The Fees and Expenses for the Services
  • The Payment Terms and Invoicing Requirements
  • The Insurance requirements for the Supplier
  • The Key Personnel assigned by the Supplier
  • The Intellectual Property Rights ownership and licensing arrangements
  • The Confidential Information obligations and exceptions
  • The Data Security Standards and Privacy Laws compliance
  • The Dispute Resolution process and escalation procedures
